Florida Certification (Marceno)

IS CARMINE MARCENO A CERTIFIED POLICE OFFICER IN THE STATE OF FLORIDA?

Here are the facts as concluded by FDLE/OEI (Florida Department of Law Enforcement - Office of Executive Investigations). The full report is located at the bottom of this page (Exhibit 1) . The FDLE final findings are finalized on page 5 of investigative report EI 14 0168 (Exhibit 1). It is noted on the last point of the Findings that "Per Sheriff Marceno, he noted he was a part-time Seasonal Park Ranger with Suffolk County Parks on Article 15 Registration" (Exhibit 2 - EI 14 0168). There is further support that can be found in the summarized time sheets (Exhibit 2 and Exhibit 3 Summary) which shows that Marceno worked only in a part time capacity prior to moving to Florida to seek employment as a police officer.

In the FDLE report, EI 14 0168, the findings concludes with the statement from Investigator Meschelle F. Pittman that, "a copy of this summary will be provided to the FDLE Criminal Justice Professional Division for review and any action they deem appropriate". The Criminal Justice Standards and Training Council (CJSTC) has oversight of certification of Police Officers in the State of Florida. Florida State Statue 943 requires any certified officer coming from outside the State of Florida must have served one year full time service to qualify for the police training academy exemption in Florida (Exhibit 4).

FSS 943.13 (9) (a) Completed a comparable basic recruit training program for the applicable criminal justice discipline in another state or for the Federal Government and served as a full-time sworn officer in another state or for the Federal Government for at least 1 year, provided there is no more than an 8-year break in employment, as measured from the separation date of the most recent qualifying employment to the time a complete application for an exemption under this subsection is submitted; ....

In summary, Marceno did not have the one year of full time police experiences as required by FSS 943.13 prior to coming to the State of Florida (Exhibit 3). Marceno acknowledges that he was a part time police office in the State of New York by his signature on Article 15 from the State of New York (Exhibit 2) and further by his submitted time sheets to payroll (Exhibit 2 - last pages) with a summary in Exhibit 3.
